The Supreme Court Reinstates Restrictions on Land Purchases by Foreigners

Argentina’s Supreme Court temporarily suspended Article 154 of Javier Milei’s sweeping Emergency Decree 70/2023, the provision that had repealed the Land Law, thereby reinstating the limits on the purchase of rural land by foreigners. That law, enacted in 2011, sets a 15% cap on foreign ownership of rural land, an additional 15% cap per country of origin, and restrictions near the border and bodies of water.

The ruling comes ten days after the same court had authorized such purchases without limits, a move that sparked backlash and led the opposition to call on Congress to annul the entire decree. The case was filed by provincial legislator María Magdalena Odarda, the NGO Árbol de Pie, and indigenous communities. The judges invoked Article 41 of the Constitution and the Escazú Agreement to prevent “irreparable harm” and remanded the case to Bariloche. The validity of the repeal remains in question.
