Argentine Court Rules Milei's Decree Blocking the University Funding Law Unconstitutional

milei.news

A federal administrative court in Argentina upheld the national universities’ challenges to Decree 759, through which Milei had enacted the university funding law but suspended its implementation until Congress specified the source of the funds. Judge Martín Cormick ruled that the decree “fails to meet a minimum standard of reasonableness” and that the law itself already establishes funding guidelines in Article 9. Argentine media reported that the government is preparing an appeal.

The law, which adjusts faculty salaries and university funding eroded by inflation, had been vetoed twice by Milei, and both vetoes were overturned by Congress. The Supreme Court had already rejected an appeal by the executive branch against a previous preliminary injunction ordering compliance with the law. According to a report cited in the article, the university budget fell this year to its lowest level since 1989.
